The Types Of Wage Loss Benefits Available To Work Accident Victims
Depending on the duration and the extent of the injury, you may qualify for one of four types of wage loss benefits:
- Temporary partial disability benefits: A temporary partial disability is a disability that you are projected to recover from but will impact your ability to work until you recover. You are able to work, but you are not able to return to your previous job and must work at a lesser paying job. In these cases, you are entitled to compensation that covers two-thirds of the difference between your current wage and the wage you were earning prior to the accident. This compensation is available for a maximum of 225 weeks.
- Temporary total disability benefits: A temporary total disability is a disability that you are projected to recover from, but completely prevents you from working until you recover. In these cases, you are entitled to compensation for two-thirds of the wages you were earning prior to the accident. This compensation is available for up to 104 weeks.
- Permanent partial disability benefits: A permanent partial disability is a disability that you will not recover from, but does not prevent you from returning to work. These benefits are based not on wages, but on the percentage of disability.
- Permanent total disability benefits: A permanent total disability is a disability that completely prevents you from ever returning to work. In these cases, you are entitled to compensation for two-thirds of the wages you were earning prior to the accident. You will be able to receive this compensation until you reach retirement age.
